征信管理辦法英文一、總則（一）目的本辦法旨在規(guī)范征信業(yè)務(wù)活動(dòng)，保護(hù)信息主體合法權(quán)益，促進(jìn)征信業(yè)健康發(fā)展，維護(hù)金融穩(wěn)定和社會(huì)信用體系建設(shè)。英文表述為：ThisMeasuresaimstoregulatecreditreportingbusinessactivities,protectthelegitimaterightsandinterestsofinformationsubjects,promotethehealthydevelopmentofthecreditreportingindustry,andsafeguardfinancialstabilityandtheconstructionofthesocialcreditsystem.（二）適用范圍本辦法適用于在中華人民共和國境內(nèi)從事征信業(yè)務(wù)及相關(guān)活動(dòng)的機(jī)構(gòu)。英文表述為：TheseMeasuresapplytoinstitutionsengagedincreditreportingbusinessandrelatedactivitieswithintheterritoryofthePeople'sRepublicofChina.（三）基本原則1.合法合規(guī)原則：征信業(yè)務(wù)活動(dòng)應(yīng)當(dāng)遵守法律法規(guī)，不得損害國家利益、社會(huì)公共利益和他人合法權(quán)益。英文表述為：Theprincipleoflegalityandcompliance:Creditreportingbusinessactivitiesshallcomplywithlawsandregulationsandshallnotharmthenationalinterests,socialpublicinterestsandthelegitimaterightsandinterestsofothers.2.真實(shí)性原則：征信機(jī)構(gòu)采集、整理、保存、加工個(gè)人和企業(yè)信用信息，應(yīng)當(dāng)遵循真實(shí)性原則，不得虛構(gòu)、篡改、隱匿信息。英文表述為：Theprincipleofauthenticity:Creditreportinginstitutionsshallfollowtheprincipleofauthenticitywhencollecting,organizing,storingandprocessingpersonalandenterprisecreditinformation,andshallnotfabricate,tamperwithorconcealinformation.3.客觀性原則：征信機(jī)構(gòu)應(yīng)當(dāng)采取合理措施，保障所采集、整理、保存、加工的信用信息的客觀性。英文表述為：Theprincipleofobjectivity:Creditreportinginstitutionsshalltakereasonablemeasurestoensuretheobjectivityofthecreditinformationcollected,organized,storedandprocessed.4.保密原則：征信機(jī)構(gòu)及其工作人員對(duì)在業(yè)務(wù)活動(dòng)中知悉的國家秘密、商業(yè)秘密和個(gè)人隱私，應(yīng)當(dāng)予以保密。英文表述為：Theprincipleofconfidentiality:Creditreportinginstitutionsandtheirstaffshallkeepconfidentialthestatesecrets,businesssecretsandpersonalprivacyknowninthecourseofbusinessactivities.二、征信機(jī)構(gòu)（一）定義與設(shè)立條件征信機(jī)構(gòu)是指依法設(shè)立，主要經(jīng)營征信業(yè)務(wù)的機(jī)構(gòu)。設(shè)立征信機(jī)構(gòu)，應(yīng)當(dāng)符合《中華人民共和國公司法》規(guī)定的公司設(shè)立條件和下列條件，并經(jīng)國務(wù)院征信業(yè)監(jiān)督管理部門批準(zhǔn)：1.有符合國務(wù)院征信業(yè)監(jiān)督管理部門規(guī)定的保障信息安全的設(shè)施、設(shè)備和制度、措施；英文表述為：Therearefacilities,equipment,systemsandmeasuresforensuringinformationsecuritythatmeettherequirementsofthecreditreportingregulatorydepartmentoftheStateCouncil.2.有健全的組織機(jī)構(gòu)和管理制度；英文表述為：Therearesoundorganizationalstructuresandmanagementsystems.3.董事、監(jiān)事和高級(jí)管理人員具備任職資格；英文表述為：Directors,supervisorsandseniormanagementpersonnelhavethequalificationsfortakingoffice.4.國務(wù)院征信業(yè)監(jiān)督管理部門規(guī)定的其他審慎性條件。英文表述為：OtherprudentconditionsstipulatedbythecreditreportingregulatorydepartmentoftheStateCouncil.（二）業(yè)務(wù)范圍征信機(jī)構(gòu)可以經(jīng)營下列部分或者全部征信業(yè)務(wù)：1.個(gè)人征信業(yè)務(wù)；英文表述為：Personalcreditreportingbusiness.2.企業(yè)征信業(yè)務(wù)；英文表述為：Enterprisecreditreportingbusiness.3.信用評(píng)級(jí)服務(wù)；英文表述為：Creditratingservices.4.其他依法經(jīng)批準(zhǔn)的征信業(yè)務(wù)。英文表述為：Othercreditreportingbusinessapprovedbylaw.（三）經(jīng)營規(guī)則1.征信機(jī)構(gòu)應(yīng)當(dāng)依法收集、整理、保存、加工個(gè)人和企業(yè)信用信息，并按照規(guī)定提供信用報(bào)告、信用評(píng)分、信用評(píng)級(jí)等產(chǎn)品和服務(wù)。英文表述為：Creditreportinginstitutionsshallcollect,organize,storeandprocesspersonalandenterprisecreditinformationinaccordancewiththelawandprovideproductsandservicessuchascreditreports,creditscoresandcreditratingsinaccordancewiththeregulations.2.征信機(jī)構(gòu)不得采集法律、行政法規(guī)禁止采集的個(gè)人信息。英文表述為：Creditreportinginstitutionsshallnotcollectpersonalinformationprohibitedbylawsandadministrativeregulations.3.征信機(jī)構(gòu)應(yīng)當(dāng)按照與信息主體約定的用途使用個(gè)人信用信息，不得用作約定以外的用途，不得未經(jīng)信息主體同意向第三方提供。英文表述為：Creditreportinginstitutionsshallusepersonalcreditinformationforthepurposesagreedwiththeinformationsubjects,shallnotuseitforpurposesotherthantheagreedones,andshallnotprovideittothirdpartieswithouttheconsentoftheinformationsubjects.4.征信機(jī)構(gòu)應(yīng)當(dāng)建立健全信息系統(tǒng)，保障信息安全。英文表述為：Creditreportinginstitutionsshallestablishandimproveinformationsystemstoensureinformationsecurity.5.征信機(jī)構(gòu)應(yīng)當(dāng)按照規(guī)定向國務(wù)院征信業(yè)監(jiān)督管理部門報(bào)送有關(guān)信息和資料。英文表述為：CreditreportinginstitutionsshallsubmitrelevantinformationandmaterialstothecreditreportingregulatorydepartmentoftheStateCouncilinaccordancewiththeregulations.三、征信業(yè)務(wù)規(guī)則（一）信息采集1.征信機(jī)構(gòu)采集個(gè)人信息，應(yīng)當(dāng)經(jīng)信息主體本人同意。未經(jīng)本人同意，不得采集。英文表述為：Whencollectingpersonalinformation,creditreportinginstitutionsshallobtaintheconsentoftheinformationsubjectsthemselves.Withouttheirconsent,suchinformationshallnotbecollected.2.征信機(jī)構(gòu)采集企業(yè)信息，可以通過信息主體自主提供、企業(yè)交易對(duì)方提供、行業(yè)協(xié)會(huì)提供、政府有關(guān)部門依法已公開的信息等渠道進(jìn)行。英文表述為：Whencollectingenterpriseinformation,creditreportinginstitutionsmaydosothroughchannelssuchastheinformationprovidedbytheinformationsubjectsthemselves,theinformationprovidedbythetradingpartnersoftheenterprises,theinformationprovidedbyindustryassociations,andtheinformationpubliclyavailableaccordingtolawbyrelevantgovernmentdepartments.3.征信機(jī)構(gòu)不得采集個(gè)人的宗教信仰、基因、指紋、血型、疾病和病史信息以及法律、行政法規(guī)規(guī)定禁止采集的其他個(gè)人信息。英文表述為：Creditreportinginstitutionsshallnotcollectpersonalinformationsuc
