1Interpretation

Inthisagreement-

(a)areferencetothepremisesincludesareferencetoany

inclusionsforthepremisesstatedinthisagreementforitem

5.2;and

(b)areferencetoanumberedsectionisareferencetothesectionintheActwiththatnumber;and

(c)areferencetoanumbereditemisareferencetotheitemwiththatnumberinpart1;and

(d)areferencetoanumberedclauseisareferencetotheclauseofthisagreementwiththatnumber

2Termsofageneraltenancyagreement

(1)Thispartstates,undertheResidentialTenanciesandRoomingAccommodationAct2008(theAct),section55,thestandardtermsofageneraltenancyagreement.

(2)TheActalsoimposesdutieson,andgivesentitlementsto,thelessorandtenantthataretakentobeincludedastermsofthisagreement.

(3)Thelessorandtenantmayagreeonothertermsofthisagreement(specialterms).

(4)AdutyorentitlementundertheActoverridesastandardtermorspecialtermifthetermisinconsistentwiththedutyorentitlement.

(5)Astandardtermoverridesaspecialtermiftheyareinconsistent.Note-SomebreachesofthisagreementmayalsobeanoffenceundertheAct,forexample,if-

·thelessororthelessor'sagententersthepremisesincontraventionoftherulesofentryundersections192to199;or

·thetenantdoesnotsignandreturntheconditionreporttothelessororthelessor'sagentundersection65.

3Morethan1lessorortenant

(1)Thisclauseappliesifmorethan1personisnamedinthisagreementforitem1or2.

(2)Eachlessornamedinthisagreementforitem1mustperformallofthelessor'sobligationsunderthisagreement.

(3)Eachtenantnamedinthisagreementforitem2-

(a)holdstheirinterestinthetenancyasatenantincommonunlessaspecialtermstatesthetenantsarejointtenants;and

(b)mustperfomallthetenant'sobligationsunderthisagreement.

Division2Periodoftenancy

4Startoftenancy

(1)Thetenancystartsonthedaystatedinthisagreementforitem6.2.

(2)However,ifnodayisstatedorifthestateddayisbeforethesigningofthisagreement,thetenancystartswhenthetenantisorwasgivenarighttooccupythepremises.

5Entryconditionreport-s65

(1)Thelessormustprepare,intheapprovedform,signandgivethetenant1copyofaconditionreportforthepremises.

(2)Thecopymustbegiventothetenantonorbeforethedaythetenantoccupiesthepremisesunderthisagreement.

(3)Thetenantmustmarkthecopyofthereporttoshowanypartsthetenantdisagreeswith,andsignandreturnthecopytothelessornotlaterthan3daysafterthelaterofthefollowingdays-

(a)thedaythetenantisentitledtooccupythepremises;

(b)thedaythetenantisgiventhecopyoftheconditionreport.Note-Awellcompletedconditionreportcanbeveryimportanttohelpthepartiesifthereisadisputeabouttheconditionofthepremiseswhenthetenancystarted.Formoreinformationaboutconditionreports,

seetheinformationstatement.

(4)Afterthecopyoftheconditionreportisreturnedtothelessorbythetenant,thelessormustcopytheconditionreportandreturnittothetenantwithin14days.

6Continuationoffixedtermagreement-s70

(1)Thisclauseappliesif-

(a)thisagreementisafixedtermagreement;and

(b)noneofthefollowingnoticesaregiven,oragreements

orapplicationsmadebeforethedaythetermends(theendday)-

()anoticetoleave;

(i)anoticeofintentiontoleave;

(ii)anabandonmentterminationnotice;

(iv)anotice,agreementorapplicationrelatingtothedeathofasoletenantundersection277(7);

(v)awrittenagreementbetweenthelessorandtenanttoendtheagreement.

(2)Thisagreement,otherthanatermaboutthisagreement'sterm,continuestoapplyaftertheenddayonthebasisthatthetenantisholdingoverunderaperiodicagreement.

7Costsapplytoearlyendingoffixedtermagreement

(1)Thisclauseappliesif-

(a)thisagreementisafixedtermagreement;and

(b)thetenantterminatesitbeforethetermendsinawaynotpermittedundertheAct.

(2)Thetenantmustpaythereasonablecostsincurredbythelessorinrelettingthepremises.

Note-ForwhenthetenantmayterminateearlyundertheAct,see

clause36andtheinformationstatement.Undersection362,thelessorhasageneraldutytomitigate(avoidorreduce)thecosts.

Division3Rent

8When,howandwhererentmustbepaid

(1)Thetenantmustpaytherentstatedinthisagreementforitem7.

(2)Therentmustbepaidatthetimesstatedinthisagreementforitem8.

(3)Therentmustbepaid-

(a)inthewaystatedinthisagreementforitem9;or

(b)inthewayagreedafterthesigningofthisagreementby-

()thelessorortenantgivingtheotherpartyanoticeproposingtheway;and

(i)theotherpartyagreeingtotheproposalinwriting;or

(c)ifthereisnowaystatedinthisagreementforitem9ornowayagreedafterthesigningofthisagreement-inanapprovedwayundersection83(4).

Note-Ifthewayrentistobepaidisanotherwayagreedonbythelessorandtenantundersection83(4)(g),thelessororthelessor'sagentmustcomplywiththeobligationsundersection84(2).

(4)Therentmustbepaidattheplacestatedinthisagreementforitem10.

(5)However,if,afterthesigningofthisagreement,thelessorgivesanoticetothetenantstatingadifferentplaceforpaymentandtheplaceisreasonable,therentmustbepaidattheplacewhilethenoticeisinforce.

(6)Ifnoplaceisstatedinthisagreementforitem10andthereisnonoticestatingaplacetherentmustbepaidatanappropriateplace.Examplesofanappropriateplace-

9Rentinadvance-s87

Thelessormayrequirethetenanttopayrentinadvanceonlyifthepaymentisnotmorethan-

requireapaymentofrentunderthisagreementinaperiodforwhichrenthasalreadybeenpaid.

10Rentincreases-ss91and93

(1)Ifthelessorproposestoincreasetherent,thelessormustgivenoticeoftheproposaltothetenant.

(2)Thenoticemuststatetheamountoftheincreasedrentandthedayfromwhenitispayable.

(3)Thedaystatedmustnotbeearlierthanthelaterofthefollowing-

(a)2monthsafterthenoticeisgiven;

(b)6monthsafterthedaytheexistingrentbecamepayablebythetenant.

(4)Subjecttoanorderofatribunal,theincreasedrentispayable

fromthedaystatedinthenotce,andthisagreementistaken

tobeamendedaccordingly.

(5)However,ifthisagreementisafixedtermagreement,therentmaybeincreasedbeforethetermendsonlyifaspecialterm-

(a)providesforarentincrease;and

(b)statestheamountoftheincreaseorhowtheamountoftheincreaseistobeworkedout.

(6)Arentincreaseispayablebythetenantonlyiftherentisincreasedunderthisclause.

11Applicationtotribunalaboutexcessiveincrease

(1)Ifanoticeofproposedrentincreaseisgivenandthetenant

considerstheincreaseisexcessive,thetenantmayapplyto

atribunalforanordersettingasideorreducingtheincrease.

(2)However,theapplicationmustbemade-

(a)within30daysafterthenoticeisreceived;and

(b)forafixedtermagreement-beforethetermends.

12Rentdecreases-s94

Division4Rentalbond

13Rentalbondrequired-ss111and116

(1)Ifarentalbondisstatedinthisagreementforitem11,thetenantmustpaytothelessororthelessor'sagenttherentalbondamount-

(a)ifaspecialtermrequiresthebondtobepaidatastatedtime-atthestatedtime;or

(b)ifaspecialtermrequiresthebondtobepaidbyinstalments

-byinstalments;or

(c)otherwise-whenthetenantsignsthisagreement.

Note-ThereisamaximumbondthatmayberequiredSeesection146andtheinformationstatement.

(2)Thelessororthelessor'sagentmust,within10daysofreceivingthebondorapartofthebond,payittotheauthorityandgive

theauthorityanotice,intheapprovedform,aboutthebond.

(3)Thebondisintendedtobeavailabletofinanciallyprotectthelessorifthetenantbreachesthisagreement.

Example-Thelessormayclaimagainstthebondifthetenantdoesnotleavethepremisesintherequiredconditionattheendofthetenancy.Note-Forhowtoapplytotheauthorityoratribunalforthebondat

theendofthetenancy,seetheinformationstatementandsections125to141.Delayinapplyingmaymeanthatpaymentismadeonanotherapplicationforpayment.

14Increaseinbond-s154

(1)Thetenantmustincreasetherentalbondif-

(a)therentincreasesandthelessorgivesnoticetothetenanttoincreasethebond;and

(b)thenoticeisgivenatleast11monthsafter-

(①)thisagreementstarted;or

(i)ifthebondhasbeenincreasedpreviouslybyanoticegivenunderthisclause-thedaystatedinthenotice,orthelastnotice,formakingtheincrease.

Division5Outgoings

(1)Thelessormustpayallcharges,levies,premiums,ratesortaxesforthepremises,otherthanaservicecharge.

Examples-

bodycorporatelevies,councilgeneralrates,seweragecharges,environmentlevies,landtax

(2)Thisclausedoesnotapplyif一

(a)thelessoristheState;and

b)rentisnotpayableundertheagreement;and

(c)thetenantisanentityreceivingfinancialorotherassistance

fromtheStatetosupplyrentedaccommodationtopersons.

16Generalservicecharges-ss164and165

Thetenantmustpayaservicecharge,otherthanawater

servicecharge,foraservicesuppliedtothepremisesduringthetenancyif-

(a)thetenantenjoysorsharesthebenefitoftheservice;and

(b)theserviceisstatedinthisagreementforitem12.1;and

(c)either-

()thepremisesareindividuallymeteredfortheservice;or

(i)thisagreementstatesforitem13howthetenant's

apportionmentofthecostoftheserviceistobeworkedout;and

(d)thisagreementstatesforitem14howthetenantmustpayfortheservice.

17Waterservicecharges-ss164and166

(1)Thetenantmustpayanamountforthewaterconsumptionchargesforthepremisesif-

(a)thetenantisenjoyingorsharingthebenefitofawaterservicetothepremises;and

(b)thepremisesareindividuallymeteredforthesupplyofwaterorwaterissuppliedtothepremisesbydeliverybymeansofavehicle;and

(c)thisagreementstatesforitem12.2thatthetenantmustpayforwatersuppliedtothepremises.

Note-Awaterconsumptionchargedoesnotincludetheamountofawaterservicechargethatisafixedchargeforthewaterservice.

(2Howeverthetenantdoesnothavetopayanamount-

(a)thatismorethantheamountofthewaterconsumption

chargespayabletotherelevantwatersupplier;or

(b)thatisafixedchargeforthewaterservicetothepremises.

(3)Also,thetenantdoesnothavetopayanamountfora

periodif,duringtheperiod,thepremisesarenotwaterefficient

reasonablequantityofwatersuppliedtothepremisesfora

forsection166.

(4)Indecidingwhatisareasonablequantityofwaterforsubclause

(3),regardmustbehadtothemattersmentionedinsection169(4)(a)to(e).

(5)Thetenantmustpaytheamountofthechargetothelessor

within1monthofthelessorgivingthetenantcopiesofrelevant

documentsabouttheincurringoftheamount.

(6)Inthisclause-

waterconsumpioncharge,forpremises,meansthevariablepartofawaterservicechargeassessedonthevolumeofwatersuppliedtothepremises.

Note-Ifthereisadisputeabouthowmuchwater(oranyotherservicecharge)thetenantshoudpay,thelessororthetenantmayattempt

Thelessormustensurethereisnolegalimpedimentto

occupationofthepremisesbythetenantasaresidenceforthetermofthetenancyif,whenenteringintothisagreement,thelessorknewabouttheimpedimentoroughtreasonablytohaveknownaboutit.

Examplesofpossiblelegalimpediments-

·ifthereisamortgageoverthepremises,thelessormightneedtoobtainapprovalfromthemortgageebeforethetenancycanstart

·acertificatemightberequiredundertheBuildingAct1975beforethepremisescanlawfullybeoccupied

·thezoningofthelandmightpreventuseofabuildingonthelandasaresidence

19Vacantpossessionandquietenjoyment

(1)Thelessormustensurethetenanthasvacantpossessionofthe

premises(otherthanapartofthepremisesthatthetenantdoes

nothavearighttooccupyexclusively)onthedaythetenantis

entitledtooccupythepremisesunderthisagreement.

(2)Thelessormusttakereasonablestepstoensurethetenanthasquietenjoymentofthepremises.

(a)usethepremisesforanillegalpurpose;or

(b)causeanuisancebytheuseofthepremises;orExamplesofthingsthatmayconstituteanuisance-

·usingpaintsorchemicalsonthepremisesthatgoontoorcauseodoursonadjoiningland

·causingloudnoises

·allowinglargeamountsofwatertoescapeontoadjoinngland

(c)interferewiththereasonablepeace,comfortorprivacyofaneighbourofthetenant;or

(d)allowanotherpersononthepremisestointerferewiththereasonablepeace,comfortorprivacyofaneighbourof

thetenant.

22Unitsandtownhouses-s69

(1)Thelessormustgivethetenantacopyofanybodycorporateby-lawsundertheBodyCorporateandCommunity

ManagementAct1997orBuildingUnitsandGroupTitlesAct1980applicableto-

(a)theoccupationofthepremises;or

(b)anycommonareaavailableforusebythetenantwiththepremises.

(2)Thetenantmustcomplywiththeby-laws.

23Numberofoccupantsallowed

Nomorethanthenumberofpersonsstatedinthisagreementforitem15mayresideatthepremises.

24Pets

(1)Thetenantmaykeeppetsonthepremisesonlyifthisagreementstatesforitem17.1thatpetsareapproved.

(2)Ifthisagreementstatesforitem17.1thatpetsareapprovedandthisagreementstatesforitem17.2thatonly-

(a)aparticulartypeofpetmaybekept,onlythattypemaybekept;or

(b)aparticularnumberofpetsmaybekept,onlythatnumbermaybekept;or

(c)aparticularnumberofaparticulartypeofpetmaybekept,onlythatnumberofthattypemaybekept.

Subdivision2Standardofpremises

25Lessor'sobligations-s185

(1)Atthestartofthetenancy,thelessormustensure-

(a)thepremisesareclean;and

(b)thepremisesarefitforthetenanttolivein;and

(c)thepremisesareingoodrepair;and

(d)thelessorisnotinbreachofalawdealingwithissuesaboutthehealthorsafetyofpersonsusingorenteringthepremises.

(2)Whilethetenancycontinues,thelessormust-

(a)maintainthepremisesinawaythatthepremisesremainfitforthetenanttolivein;and

(b)maintainthepremisesingoodrepair;and

(c)ensurethelessorisnotinbreachofalawdealingwithissuesaboutthehealthorsafetyofpersonsusingorenteringthe

premises;and

(d)keepanycommonareaincludedinthepremisesclean.

Note-Fordetailsaboutthemaintenance,seetheinformationstatement.

(3)However,thelessorisnotrequiredtocomplywithsubclause

(1)(c)or(2)(a)foranynon-standarditemsandthelessorisnotresponsiblefortheirmaintenanceif-

(a)thelessoristheState;and

(b)thenon-standarditemsarestatedinthisagreementandthisagreementstatesthelessorisnotresponsiblefortheirmaintenance;and

(c)thenon-standarditemsarenotnecessaryandreasonable

tomakethepremisesafitplaceinwhichtolive;and

(d)thenon-standarditemsarenotarisktohealthorsafety;and

(e)forfixtures-thefixtureswerenotattachedtothepremisesbythelessor.

(4)Inthisclause-

non-standarditemsmeansthefixturesattachedtothe

premisesandinclusionssuppliedwiththepremisesstatedin

thisagreementforitem5.2.

premisesincludeanycommonareaavailableforusebythetenantwiththepremises.

26Tenant'sobligations-s188(2)and(3)

(1)Thetenantmustkeepthepremisesclean,havingregardtotheirconditionatthestartofthetenancy.

(2)Thetenantmustnotmaliciouslydamage,orallowsomeoneelsetomaliciouslydamage,thepremises.

Subdivision3Thedwelling

27Fixturesorstructuralchanges-ss207-209

(1)Thetenantmayattachafixtureormakeastructuralchange,tothepremisesonlyifthelessoragreestothefixture'sattachmentorthestructuralchange.

Note-Fixturesaregenerallyitemspermanentlyattachedtolandortoabuildingthatareintendedtobecomepartofthelandorbuilding.Anattachmentmayinclude,forexample,somethingglued,nailedorscrewedtoawall.

(2)Thelessor'sagreementmustbewritten,describethenatureof

thefixtureorchangeandincludeanytermsoftheagreement.

(b)waivethebreach(thatis,nottakeactionforthebreach)

andtreatthefixtureorchangeasanimprovementtothe

premisesforthelessor'sbenefit(thatis,treatitasbelongingtothelessor,withouthavingtopaythetenantfoit).

28Supplyoflocksandkeys-s210

(1)Thelessormustsupplyandmaintainalllocksnecessarytoensurethepremisesarereasonablysecure.

(2)Thelessormustgivethetenant,orifthereismorethan1tenant,1ofthetenants,akeyforeachlockthat-
