2025設(shè)備租賃合同中英文版EquipmentRentalContract（設(shè)備租賃合同）ContractNo.:DateofContract:PlaceofExecution:ThisEquipmentRentalContract("Contract")isenteredintoonthisdayof,2025,byandbetween:1.THELessor(出租方):Name:Address:ContactInformation:2.THELessee(承租方):Name:Address:ContactInformation:WHEREAS,theLessorownsandpossessescertainequipmentwhichtheLesseedesirestoleaseforuseinconnectionwithitsbusinessoperations;andNOW,THEREFORE,inconsiderationofthemutualcovenantsandpromiseshereinaftercontained,theLessorandtheLesseeagreeasfollows:1.DescriptionofEquipment(設(shè)備描述)TheLessorshallprovidetheLesseewiththefollowingequipment(hereinafterreferredtoasthe"Equipment"):EquipmentName(設(shè)備名稱):Model(型號(hào)):SerialNumber(序列號(hào)):YearofManufacture(制造年份):Quantity(數(shù)量):Description(描述):TheEquipmentshallbeusedbytheLesseeatthelocationspecifiedasfollows:UseLocation(使用地點(diǎn)):TheLesseeagreestousetheEquipmentsolelyforthepurposestatedhereinandinaccordancewithapplicablelawsandregulations.2.TermoftheAgreement(協(xié)議期限)ThisContractshallcommenceon(the"CommencementDate")andcontinueuntil(the"ExpirationDate"),unlessterminatedearlierinaccordancewiththeprovisionsofthisContract.TheLesseemayextendthetermofthisContractbydaysbyprovidingwrittennoticetotheLessoratleastdayspriortotheExpirationDate.3.RentalFeesandPaymentTerms(租金及支付條款)3.1RentalFees(租金費(fèi)用):TheLesseeshallpaytotheLessorthemonthlyrentalfee(the"RentalFee")asfollows:MonthlyRentalFee(月租金):$.TheRentalFeeshallbesubjecttoadjustmentinaccordancewiththetermsofthisContractoranyapplicablelawsorregulations.3.2PaymentConditions(支付條件):TheLesseeshallpaytheRentalFeeinfullontheofeachmonth(the"PaymentDate").TheLesseeshallpaybybanktransferorsuchothermethodasagreeduponinwritingbytheLessorandtheLessee.TheLesseeagreestopayanyapplicabletaxes,duties,orfeesimposedbyanygovernmentalauthorityinconnectionwiththeEquipmentunderthisContract.3.3LatePayment(逾期支付):IftheLesseefailstomakepaymentonorbeforethePaymentDate,theLessormaychargealatefeeof%oftheoverdueamountpermonth.4.ResponsibilitiesandObligationsoftheParties(雙方的責(zé)任和義務(wù))4.1ObligationsoftheLessor(出租方的義務(wù)):TheLessorshall:ProvidetheEquipmenttotheLesseeinaqualityandconditionsuitableforitsintendeduse,asdescribedinthisContract.DelivertheEquipmenttotheagreedlocationonorbeforetheCommencementDate.EnsuretheEquipmentcomplieswithallapplicablelaws,regulations,andstandards.4.2ObligationsoftheLessee(承租方的義務(wù)):TheLesseeshall:PaytheRentalFeeandotherchargesinfullandontime.UsetheEquipmentstrictlyforthepurposestatedhereinandinaccordancewiththemanufacturer'sinstructionsandapplicablelawsandregulations.MaintaintheEquipmentingoodconditionandpromptlyreportanydamageormalfunctiontotheLessor.ReturntheEquipmenttotheLessorattheendoftheleasetermingoodworkingorder,normalwearandtearexcepted.5.UseandMaintenanceofEquipment(設(shè)備使用和維護(hù))5.1UseofEquipment(設(shè)備使用):TheLesseeshallusetheEquipmentinamannerthatdoesnotexceeditsdesigncapacityorspecifications.TheLesseeshallnotsublease,assign,ortransfertheEquipmentwithoutthepriorwrittenconsentoftheLessor.5.2Maintenance(維護(hù)):TheLesseeshallberesponsiblefortheroutinemaintenanceandrepairsoftheEquipmentduringtheleaseterm.TheLesseeshallbearthecostofanyrepairsrequiredduetomisuseornegligence.TheLessorshallperformanynecessarymaintenanceorrepairstotheEquipmentatitsdiscretiontoensuretheEquipmentremainsingoodworkingorder.6.Insurance(保險(xiǎn))6.1Lessee'sInsurance(承租方保險(xiǎn)):TheLesseeshallobtainandmaintaininsurancecoveragefortheEquipmentduringtheleaseterm.Suchinsuranceshallinclude,butnotbelimitedto,(e.g.,third-partyliability,propertydamage).TheLesseeshallprovidetheLessorwithacopyoftheinsurancepolicyuponrequest.6.2Lessor'sInsurance(出租方保險(xiǎn)):TheLessorshallmaintaininsurancecoveragefortheEquipmentassetforthinthisContract.7.Liability(責(zé)任)7.1GeneralLiability(一般責(zé)任):TheLesseeshallbeliableforanydamagetotheEquipmentcausedbymisuse,neglect,orfailuretofollowthemanufacturer'sinstructions.7.2LimitationofLiability(責(zé)任限制):TheLessorshallnotbeliableforanyindirect,incidental,orconsequentialdamagesresultingfromtheuseoftheEquipment,unlesssuchdamagesaredirectlyattributabletotheLessor'snegligenceorbreachofthisContract.8.TerminationandReturnofEquipment(終止和設(shè)備返還)8.1Termination(終止):EitherpartymayterminatethisContractupondays'writtennoticetotheotherparty,providedthatthereasonforterminationissetforthinsuchnotice.8.2ReturnofEquipment(設(shè)備返還):UponexpirationorearlierterminationofthisContract,theLesseeshallreturntheEquipmenttotheLessoratthelocationspecifiedherein.TheLesseeshallbearthecostoftransportationunlessotherwiseagreedinwriting.TheLessorshallinspecttheEquipmentuponreturn.IftheEquipmentisfoundtobedamagedorinpoorconditionbeyondnormalwearandtear,theLesseeshallbeliableforthecostsofrepairorreplacement.9.GoverningLawandDisputeResolution(適用法律和爭(zhēng)議解決)9.1GoverningLaw(適用法律):ThisContractshallbegovernedbyandconstruedinaccordancewiththelawsof.9.2DisputeResolution(爭(zhēng)議解決):AnydisputesarisingoutoforrelatingtothisContractshallberesolvedamicablythroughmutual協(xié)商
