EXPLANATORYMEMORANDUM

CONTEXTOFTHEDELEGATEDACT

ThisRegulationaimstotakeintoaccountthelatesttechnicalandregulatorydevelopmentsattheWorldForumfortheHarmonisationofVehicleRegulations(WP.29)oftheUnitedNationsEconomicCommissionforEurope(UNECE).Inthisregard,thelistoftheUNRegulationsreferredtoinArticle4(2)ofRegulation(EU)2019/2144oftheEuropeanParliamentandoftheCouncilandcontainedinAnnexItothatRegulationshouldbeupdatedbyincludingreferencestonewUNRegulationsandrelevantnewseriesofamendmentsofexistingUNRegulations,thatapplyoncompulsorybasisforthepurposeofgrantinganEUtype-approval.

Inaddition,AnnexIItoRegulation(EU)2019/2144,containingthelistofrequirementsreferredtoinArticle4(5)andArticle5(3)ofthatRegulation,shouldbecomplementedwithreferencestotheregulatoryacts,adoptedpursuanttothatRegulationfollowingitsadoptionandentryintoforce.Inparticular,referenceisneededtotheregulatoryactsasregardstheAdvancedDriverDistractionWarningSystem,theDirectVisionfortrucksandbusesandtheDriverControlAssistanceSystems.

AnnexesIandIItoRegulation(EU)2019/2144arethereforeamendedinaccordancewiththeAnnexestothisRegulation.

CONSULTATIONSPRIORTOTHEADOPTIONOFTHEACT

Inthepreparationofthisact,theCommissioncarriedoutappropriateconsultationwiththeMemberStatesexpertson2Julyand4December2024,wherethedraftwasbroadlysupported.TheMemberStatesrepresentativesendorsedthedraftactduringtheMemberStatesExpertGroup(MSEG)meetingheldon6May2025.

InaccordancewiththeBetterRegulationrules,thedraftdelegatedactwaspublishedonthe"Haveyoursay"portalforafour-weekfeedbackperiodbetween10December2024and7January2025.Intotal,fivestakeholdersprovidedfeedback.TheCommissioncarefullyconsideredandtooknoteofallthecommentsreceived.

No1276andUNRegulationNo1527.AllthoseregulationshavebeenamendedbytheWorldForumforHarmonisationofVehicleRegulationsoftheUnitedNationsEconomicCommissionforEurope(‘UNECEWP.29’).ItisthereforeappropriatethatthelistinAnnexItoRegulation(EU)2019/2144isupdatedtoreflectthoseamendments.

The02seriesofamendmentstoUNRegulationNo152containprovisionsfortheadvancedemergencybrakingsystemtoavoidormitigatetheseverityofanimpactwithapedestrianandabicyclerespectively.AnnexItoRegulation(EU)2019/2144referstotheoriginalversiontothatUNRegulationthatcontainsrequirementsforadvancedemergencybrakingsystemtoavoidormitigatecollisionwithapassengercaronly.Therefore,inordertocoverinadditiontothecar-to-carthecar-to-pedestrianandcar-to-bicyclecollisions,itisappropriatetoreferinAnnexItoRegulation(EU)2019/2144tothe02seriesofamendmentstoUNRegulationNo152.

The04seriesofamendmentstoUNRegulationNo127containprovisionsfortheenlargedheadimpactzonetoimprovethepedestriansafetyperformanceofmotorvehiclesincaseofacollision.AsAnnexItoRegulation(EU)2019/2144refersto02seriesofamendmentsofthatUNRegulation,itisnecessarytoupdateAnnexItoRegulation(EU)2019/2144torefertothe04seriesofamendmentsofUNRegulationNo127.

TheUNECEWP.29alsoadopted:(1)UNRegulationNo167–UniformProvisionsConcerningtheApprovalofMotorVehicleswithregardtotheirDirectVision[2024/1065]8,(2)UNRegulationNo169–UniformProvisionsConcerningtheApprovalofEventDataRecorders(EDR)forHeavy-DutyVehicles[2024/1218]9and

(3)UNRegulationNo171–UniformprovisionsconcerningtheapprovalofvehicleswithregardstoDriverControlAssistanceSystems[2024/2689]10.ItisthereforeappropriatetointroduceinAnnexItoRegulation(EU)2019/2144referencestothoseregulations.

The04seriesofamendmentstoUNRegulationNo117containprovisionsfortheapprovaloftyreswithregardtotheirwetgripinwornstate.Itisappropriatetoprovideadditionaltimetocontinuetoallowfittingonavehicleinuseofnewtyresapprovedascomplyingwiththe02and03seriesofamendmentsrespectivelytoUNRegulationNo117until6January2029.

Atthe192thsessionofUNECEWP.29inMarch2024,theUnionanditsMemberStatesvotedinfavourofthenewUNRegulationonuniformprovisionsconcerningtheapprovalofvehicleswithregardstodrivercontrolassistancesystems.InorderformotorvehiclesfittedwiththosesystemstocomplywiththeprovisionssetoutinthatUNRegulation,itisnecessarytoincludethereferencetoUNRegulationNo171inAnnexIItoRegulation(EU)2019/2144thatshouldapplyon“iffitted”basis.

Regulation(EU)2019/2144shouldthereforebeamendedaccordingly,HASADOPTEDTHISREGULATION:
