海洋運輸貨物保險條款（附英文）一、責任范圍本保險分為平安險、水漬險及一切險三種。被保險貨物遭受損失時，本保險按照保險單上訂明承保險別的條款規(guī)定，負賠償責任。（一）平安險本保險負責賠償：1、被保險貨物在運輸途中由于惡劣氣候、雷電、海嘯、地震、洪水自然災害造成整批貨物的全部損失或推定全損。當被保險人要求賠付推定全損時，須將受損貨物及其權(quán)利委付給保險公司。被保險貨物用駁船運往或運離海輪的，每一駁船所裝的貨物可視作一個整批。推定全損是指被保險貨物的實際全損已經(jīng)不可避免，或者恢復、修復受損貨物以及運送貨物到原訂目的地的費用超過該目的地的貨物價值。2、由于運輸工具遭受擱淺、觸礁、沉沒、互撞、與流冰或其他物體碰撞以及失火、爆炸意外事故造成貨物的全部或部份損失。3、在運輸工具已經(jīng)發(fā)生擱淺、觸礁、沉沒、焚毀意外事故的情況下，貨物在此前后又在海上遭受惡劣氣候、雷電、海嘯等自然災害所造成的部份損失。4、在裝卸或轉(zhuǎn)運時由于一件或數(shù)件整件貨物落海造成的全部或部份損失。5、被保險人對遭受承保責任內(nèi)危險的貨物采取搶救、防止或減少貨損的措施而支付的合理費用，但以不超過該批被救貨物的保險金額為限。6、運輸工具遭遇海難后，在避難港由于卸貨所引起的損失以及在中途港，避難港由于卸貨，存?zhèn)}以及運送貨物所產(chǎn)生的特別費用。7、共同海損的犧牲、分攤和救助費用。8、運輸契約訂有“船舶互撞責任”條款，根據(jù)該條款規(guī)定應(yīng)由貨方償還船方的損失。（二）水漬險除包括上列平安險的各項責任外，本保險還負責被保險貨物由于惡劣氣候、雷電、海嘯、地震、洪水自然災害所造成的部份損失。（三）一切險除包括上列平安險和水漬險的各項責任外，本保險還負責被保險貨物在運輸途中由于外來原因所致的全部或部分損失。二、除外責任本保險對下列損失不負賠償責任：（一）被保險人的故意行為或過失所造成的損失。（二）屬于發(fā)貨人責任所引起的損失。（三）在保險責任開始前，被保險貨物已存在的品質(zhì)不良或數(shù)量短差所造成的損失。（四）被保險貨物的自然損耗、本質(zhì)缺陷、特性以及市價跌落；運輸遲延所引起的損失或費用。（五）本公司海洋運輸貨物戰(zhàn)爭險條款和貨物運輸罷工險條款規(guī)定的責任范圍和除外責任。三、責任起訖（一）本保險負“倉至倉”責任，自被保險貨物運離保險單所載明的起運地倉庫或儲存處所開始運輸時生效，包括正常運輸過程中的海上、陸上、內(nèi)河和駁船運輸在內(nèi)，直至該項貨物到達保險單所載明目的地收貨人的最后倉庫或儲存處所或被保險人用作分配、分派或非正常運輸?shù)钠渌麅Υ嫣幩鶠橹?。如末抵達上述倉庫或儲存處所，則以被保險貨物在最后卸載港全部卸離海輪后滿六十天為止。如在上述六十天內(nèi)被保險貨物需轉(zhuǎn)運到非保險單所載明的目的地時，則以該項貨物開始轉(zhuǎn)運時終止。（二）由于被保險人無法控制的運輸延遲、繞道、被迫卸貨、重行裝載、轉(zhuǎn)載或承運人運用運輸契約賦予的權(quán)限所作的任何航海上的變更或終止運輸契約，致使被保險貨物運到非保險單所載明目的地時，在被保險人及時將獲知的情況通知保險人，并在必要時加繳保險費的情況下，本保險仍繼續(xù)有效，保險責任按下列規(guī)定終止。1、被保險貨物如在非保險單所載明的目的地出售，保險責任至交貨時為止，但不論任何情況下，均以被保險貨物在卸載港全部卸離海輪后滿六十天為止。2、被保險貨物如在上述六十天期限內(nèi)繼續(xù)運往保險單所載原目的地或其他目的地時，保險責任仍按上述第（一）款的規(guī)定終止。四、被保險人的義務(wù)被保險人應(yīng)按照以下規(guī)定的應(yīng)盡義務(wù)辦理有關(guān)事項，如因未履行規(guī)定的義務(wù)而影響保險人利益時，本公司對有關(guān)損失，有權(quán)拒絕賠償。（一）當被保險貨物運抵保險單所載明的目的港（地）以后，被保險人應(yīng)及時提貨，當發(fā)現(xiàn)被保險貨物遭受任何損失，應(yīng)即向保險單上所載明的檢驗、理賠代理人申請檢驗，如發(fā)現(xiàn)被保險貨物整件短少或有明顯殘損痕跡應(yīng)即向承運人、受托人或有關(guān)當局（海關(guān)、港務(wù)當局等）索取貨損貨差證明。如果貨損貨差是由于承運人、受托人或其他有關(guān)方面的責任所造成，并應(yīng)以書面方式向他們提出索賠，必要時還須取得延長時效的認證。（二）對遭受承保責任內(nèi)危險的貨物，被保險人和本公司都可迅速采取合理的搶救措施，防止或威少貨物的損失，被保險人采取此項措施，不應(yīng)視為放棄委付的表示，本公司采取此項措施，也不得視為接受委付的表示。（三）如遇航程變更或發(fā)現(xiàn)保險單所載明的貨物、船名或航程有遺漏或錯誤時，被深險人應(yīng)在獲悉后立即通知保險人并在必要時加繳保險費，本保險才繼續(xù)有效。（四）在向保險人索賠時，必須提供下列單證：保險單正本、提單、發(fā)票、裝箱單、磅碼單、貨損貨差證明、檢驗報告及索賠清單。如涉及第三者責任，還須提供向責任方追償?shù)挠嘘P(guān)函電及其他必要單證或文件。（五）在獲悉有關(guān)運輸契約中“船舶互攜責任”條款的實際責任后，應(yīng)及時通知保險人。五、索賠期限本保險索賠時效，認被保險貨物在最后卸裁港全部卸離海輪后起算，最多不超過二年。OCEANMARINECARGOCLAUSESI.ScopeofCover:ThisinsuranceisclassifiedintothefollowingthreeConditions-FreeFromParticularAverage(F.P.A.)，WithAverage(W.A.)andAllRisks.Wherethegoodsinsuredhereundersustainlossordamage，theCompanyshallundertaketoindemnifythereforaccordingtotheinsuredConditionspecifiedinthePolicyandtheProvisionsoftheseClauses:1.FreeFromParticularAverage(F.P.A.)Thisinsurancecovers:1)TotalorConstructiveTotalLossofthewholeconsignmentherebyinsuredcausedinthecourseoftransitbynaturalcalamities:heavyweather，lightning，tsunami，earthquakeandflood.Incaseaconstructivetotallossisclaimedfor，theInsuredshallabandontotheCompanythedamagedgoodsandallhisrightsandtitlepertainingthereto.Thegoodsoneachlightertoorfromtheseagoingvesselshallbedeemedaseparaterisk.ConstructiveTotalLossreferstothelosswhereanactualtotallossappearstobeunavoidableorthecosttobeincurredinrecoveringorreconditioningthegoodstogetherwiththeforwardingcosttothedestinationnamedinthePolicywouldexceedtheirvalueonarrival.2)TotalorPartialLosscausedbyaccidentsthecarryingconveyancebeinggrounded，stranded，sunkorincollisionwithfloatingiceorotherobjectsasfireorexplosion.3)Partiallossoftheinsuredgoodsattributabletoheavyweather，lightningand/ortsunami，wheretheconveyancehasbeengrounded，stranded，sunkorburnt.irrespectiveofwhethertheeventoreventstookplaceoraftersuchaccidents.4)Partialoftotallossconsequentonfallingofentirepackageorpackagesintoseaduringloading，transshipmentordischarge.5)ReasonablecostincurredbytheinsuredonsalvagingthegoodsoravertingorminimizingalossrecoverableunderthePolicy，providedthatsuchcostshallnotexceedthesuminsuredoftheconsignmentsosaved.6)Lossesattributabletodischargeoftheinsuredgoodsatapertofdistressfollowingaseaperilaswellasspecialchargesarisingfromloading，warehousingandforwardingofthegoodsatanintermediateportofcallorrefuge.7)SacrificeinandContributiontoGeneralAverageandSalvageCharges.8)SuchproportionoflossessustainedbytheshipownersasistobereimbursedbytheCargoOwnerundertheContractofAffreightmentBothtoBlameCollisionclause.2.WithAverage(W.A.)AsidefromtheriskscoveredunderF.P.A.conditionasabove，thisinsurancealsocoverspartiallossesoftheinsuredgoodscausedbyheavyweather，lightning，tsunami，earthquakeand/orflood.3.AllRisksAsidefromtheriskscoveredundertheF.P.A.andW.A.conditionsasabove，thisinsurancealsocoverallrisksoflossofordamagetotheinsuredgoodswhetherpartialortotal，arisingfromexternalcausesinthecauseoftransit.II.Exclusions:Thisinsurancedoesnotcover:.1.Lossordamagecausedbytheintentionalactorfaultoftheinsured.2.Lossordamagefallingundertheliabilityoftheconsignor.3.Lossordamagearisingfromtheinferiorqualityorshortageoftheinsuredgoodspriortotheattachmentofthisinsurance.4.Lossordamagearisingfromnormalloss，inherentviceornatureoftheinsuredgoods，lossofmarketand/ordelayintransitandanyexpensesarisingtherefrom..5.Risksandliabilitiescoveredandexcludedbytheoceanmarine(cargo)warrisksclausesandstrike，riotandcivilcommotionclausesofthisCompany.III.CommencementtoTerminationofcover:1.WarehousetowarehousesClause:Thisinsuranceattachesfromthetimethegoodsherebyinsuredleavetheware-houseorplaceofstoragenamedinthePolicyforthecommencementofthetransitandcontinuesinforceintheordinarycourseoftransitincludingsea，landandinlandwaterwaytransitsandtransitinlighteruntiltheinsuredgoodsaredeliveredtotheconsigneesfinalwarehouseorplaceofstorageatthedestinationnamedinthePolicyortoanyotherplaceusedbytheinsuredforallocationordistributionofthegoodsorforstoriesotherthanintheordinarycourseoftransit.Thisinsuranceshall.，however，belimitedtosixty(60)daysaftercompletionofdischargeoftheinsuredgoodsfromtheseagoingvesselatthefinalportofdischargebeforetheyreachtheabovementionedwarehouseorplaceofstories.Ifpriortotheexpireoftheabovementionedsixty(60)days，theinsuredgoodsaretobeforwardedtoadestinationotherthanthatnamedinthePolicy，thisinsuranceshallterminateatthecommencementofsuchtransit.2.If，owingtodelay，deviation，forceddischarge，reshipmentortransshipmentbeyondthecontroloftheinsuredoranychangeorterminationofthevoyagearisingfromtheexerciseofalibertygrantedtotheshipownersunderthecontractofaffreightment，theinsuredgoodsarriveataportorplaceotherthanthatnamedinthePolicy，SubjecttoimmediatenoticebeinggiventotheCompanybytheinsuredandanadditionalpremiumbeingpaid，ifrepaired，thisinsuranceshallremaininforceandshallterminateashereunder:1)IftheinsuredgoodsaresoldatportorplacenotnamedinthePolicy，thisinsuranceshallterminateondeliveryofthegoodssold，butinnoeventshallthisinsuranceextendbeyondsixty(60)daysaftercompletionofdischargeoftheinsuredgoodsfromthecarryingvesselatsuchportorplace.2)IftheinsuredgoodsaretobeforwardedtothefinaldestinationnamedinthePolicyoranyotherdestination，thisinsuranceshallterminateinaccordancewithSection1above.IV.Dutyoftheinsured:Itisthedutyoftheinsuredtoattendtoallmattersasspecifiedhereunder，failingwhichthecompanyreservestherighttorejecthisclaimforanylossifandwhensuchfailureprejudicetherightsoftheCompany:1.TheinsuredshalltakedeliveryoftheinsuredgoodsingoodtimeupontheirarrivalattheportofdestinationnamedinthePolicy.Intheeventofanydamagetothegoods，theinsuredshallimmediatelyapplyforsurveytotheSurveyand/orsettlingassentstipulatedinthePolicy.Iftheinsuredgoodsarefoundshortinentirepackageorpackagesortoshowapparenttracesofdamage，theinsuredshallobtainfromtheCarrier，bailedorotherrelevantauthorities(CustomsandPortAuthoritiesetc.)certificateoflossordamageand/orsbortlandedmemo.Shouldthecarrier，bailedortheotherrelevantauthoritiesberesponsibleforsuchshortage，theinsuredshalllodgeaclaimwiththeminwritingand，ifnecessary，obtaintheirconfirmationofanextensionofthemthetimelimitofvalidityofsuchclaim.2.Theinsuredshall，andtheCompanyalso，takereasonablemeasuresimmediatelyinsalvagingthegoodsorpreventingorminimizingalossordamagethereto.ThemeasuressotakenbytheinsuredorbytheCompanyshallnotbeconsideredrespectively，asawaiverofabandonmenthereunder，orasanacceptancethereof.3.Incaseofachangeofvoyageoranyomissionorerrorinthedescriptionoftheinterest，th
