’srequest,PartyAshallprovidechaufferserviceandrelated6、甲方根據(jù)乙方的資信情況，有權(quán)要求乙方提供經(jīng)濟(jì)擔(dān)保。經(jīng)濟(jì)擔(dān)保人必須是具有代為履行或代償能力的國有企業(yè)或其他經(jīng)濟(jì)組織。PartyBshallprovideeconomicassuranceaccordingtoPartyA’srequirement.Thewarrantorshouldbenationalenterprisesorothercompaniesthathascompletecompensationalabilities.三、乙方的責(zé)任和義務(wù) PartyB ’sRightsandResponsibilities1、乙方租車提供的所有證件必須真實有效。如屬偽造或超過有效期，一切經(jīng)濟(jì)和法律責(zé)任均由乙方承擔(dān)。Toensureallthedocumentsprovidedareallrealandvalid.PartyBshallundertakealltheresponsibilitiesofeconomicandlawifanydocumentsprovidedbyPartyBarefalseoroutofvalidity.2、乙方配備的駕駛員必須持有中華人民共和國公安交通管理部門簽發(fā)的有效機(jī)動車駕駛證，并具備壹年以上的駕駛經(jīng)歷，非合同上注明的駕駛員無權(quán)駕駛甲方的車輛，否則造成的一切后果由乙方負(fù)責(zé)。ThevehiclecanonlybedrivenbylesseeoranyotherpersonwhoisconsentedbyPartyAwrittenapprovalandwhoholdsavaliddriver licenseforover’onesyearpermittedbytrafficadministrationofficeofthePeople ’sRepublicofChina,orPartyBshallundertakealltheresponsibilitiesofrelatedresponsibilitiesincludinginsuranceindemnificationclaims.3、乙方租用的車輛不能轉(zhuǎn)租、轉(zhuǎn)借、變賣、抵押，不能賦予自己對車輛任何超出本合同的其它權(quán)力。PartyBisnotallowedtore-rent,mortgage,re-selltheleasedvehicleoranyotherpowerbeyondthecontract.4、嚴(yán)禁使用車輛進(jìn)行違法活動，嚴(yán)禁使用車輛參加競賽及作測試使用，嚴(yán)禁使用車輛進(jìn)行盈利性質(zhì)的營運，嚴(yán)禁運送易燃、易爆、易腐蝕品等對車輛安全造成影響的物品。PartyBisneitherallowedtoviolatelawsandregulationsorusethevehiclefortestandcompetitionandisnotallowedtousethevehicleforprofitableserviceortransportofflammable,explosive,corrosiveorradioactivematerials,etc.harmfultovehiclesafety.5、乙方應(yīng)做到每日檢查車輛的機(jī)油、剎車油、助力轉(zhuǎn)向油、防凍液、輪胎氣壓等，發(fā)現(xiàn)問題速與甲方聯(lián)系，否則造成的一切后果由乙方負(fù)責(zé)。Tocheckondailybasisthelubricatingoil,brakefluid,coolingwater,batteryfluid,andtyreair-pressure,andimmediatelyinformPartyAifanyabnormalityisfoundout,orPartyBshallundertakealltheresponsibilities.6、乙方租用的車輛發(fā)生各類機(jī)件故障、事故車修復(fù)，必須到甲方指定的修理廠進(jìn)行修理，不得自行送外廠修理。人為造成的機(jī)件故障，修理費用自理。歸還車輛時，經(jīng)檢驗因乙方自行送外廠修理，造成車輛修理質(zhì)量低劣、不符規(guī)格的部件，需重新修復(fù)的，乙方必須承擔(dān)由此造成修復(fù)費用。Incaseofvehicledamage,PartyBshallhavethevehiclerepairedattheplacedesignatedbyPartyA.OtherwisePartyBshallpayallexpensescausedbylow-qualityrepairorequipment.PartyBshallpayexpensesforalltheman-madedamages.7、乙方若遺失牌照或有關(guān)證件，應(yīng)立刻向甲方申請補辦，補辦期間的車輛租金及補辦手續(xù)費由乙方承擔(dān)。Ifthelicenseplateoranydocumentsaboutthevehiclearelostduringtheleasingterm,PartyBshallinformPartyAandmakesubstitutionimmediatelyandbearallexpensesforthesubstitutionandrentduringthesuspenseofusingthevehicle.8、乙方要保護(hù)好甲方車輛上的特征標(biāo)志，不得涂改遺失，嚴(yán)禁私自拆、換車輛上的任何部件及設(shè)備，嚴(yán)禁拆動里程表，如有拆動，將按使用期內(nèi)規(guī)定里程總數(shù)的 5倍罰款。PartyBisnotallowedtorepairorchangeanypart,accessory,interenvironmentandexteriorappearanceoftherentedvehicle.Itisprohibitedtochangeorthrowawayanypartandequipmentorpulloutorrefitthemileagemeters.Incaseanytraceofsuchpullingoutorrefittingisfoundout,PartyBshallpayapenaltyequaltofivetimestheamountforthemileagelimiteddefinedintheleaseforthetotalleseterm.四、意外交通事故處理及保險 TrafficAccidentandInsurance1、乙方發(fā)生交通事故（包括非道路交通事故），應(yīng)立即向交通管理部門報案，保護(hù)好現(xiàn)場（快處快撤除外），并按市內(nèi) 2小時、市外 4小時的原則通知甲方，事故處理結(jié)束將交通管理部門的證明和其它索賠材料在 15天內(nèi)送交甲方，甲方據(jù)此辦理保險索賠事宜，逾期因不能提供交通管理部門證明和其它索賠材料而無法向保險公司索賠的，其事故造成的全部損失均由乙方承擔(dān)。發(fā)生事故后，未經(jīng)甲方同意，乙方不得擅自處理事故和安排修理。Incaseoftrafficaccident(includingofnon-roadaccident),PartyBshallpreservethesitewheresuchaccidenttakeplace(excludingfastdealandmoveaway)andimmediatelyreporttrafficadministrationdepartmentandinformPartyAundertheprincipleofwithin2hoursCity-inand4hoursout-of-city.PartyBshallprovideareportontheactualaccident.Certificateforcasesettlementissuedbythetrafficadministrationdepartmentandotherindemnificationdocumentswithinfifteen(15)daysshouldbetransmittedtoPartyA.PartyshallassistPartyBinhandlingaccidentsandberesponsibleforclaiminginsuranceindemnifications.IfPartyBfailstoprovidenecessarydocumentstoPartyAwithinfifteendayscountingfromthedatewhentheinsuredvehicleisrepairedorwhenthecaseisconcluded,itshallberegardedthatPartyBrevoketherightforclaimsvoluntarily.PartyBcanonlyhandletheaccidentandhavetheleasedvehiclerepairedbyPartyA ’swrittenapproval.2、事故期間，由于乙方司機(jī)駕駛引起的交通事故,根據(jù)保險的條款和交通部門裁定,第三者強(qiáng)制險部分除外，負(fù)事故次責(zé)的，賠償甲方事故費用總額的10%；負(fù)事故半責(zé)的，負(fù)責(zé)賠償甲方事故費用總額的15%；負(fù)事故主責(zé)的，賠償甲方事故費用總額的20%；負(fù)事故全責(zé)的，賠償甲方事故費用總額的

30%。IncaseofsuchaccidentcausedbyPartyB’sdesignateddriver,accordingtothejudgingoftrafficadministrationdepartmentandinsurancecompany,asidethirdpersonliabilityriskinsurance,PartyBshallpay10percentoftotalaccidentexpenseswithlesserresponsibilities;pay15percentoftotalaccidentexpenseswithhalfresponsibilities;pay15percentoftotalaccidentexpenseswithhalfresponsibilities;pay20percentoftotalaccidentexpenseswithminorresponsibilitiesandpay30percentexpensesoftotalaccidentexpenseswithwholeresponsibilities.3、乙方所租用車輛在非正式道路上發(fā)生單車輕微肇事事故，應(yīng)立即向交通管理部門報案或向保險公司報案，等待保險公司到現(xiàn)場勘查，甲方代為向保險公司索賠，保險公司實行40%的絕對免賠率，理賠不足部分由乙方承擔(dān)。Incaseofslightaccidentinnon-roadenvironment,PartyBshallreporttotrafficadministrationdepartmentortheinsurancecompanyandwaitingfortheperambulation.PartyAshallberesponsibilityforclaiminginsuranceindemnification.Insurancecompanydoesnottakeforty(40)percentexpensesoftotalaccidentexpense,soPartyBshallberesponsibleforallthedamagesasidefromtheinsuranceindemnifications.4、乙方租用甲方車輛發(fā)生各類事故后的損失費用，先由乙方支付，甲方按保險公司理賠規(guī)定辦理索賠手續(xù)，且在保險公司理賠后，由甲方退還給乙方。保險公司免賠部分由乙方承擔(dān)。Incaseofvehicledamages,PartyBshallpaytotalexpensesfirstly.PartyAshallberesponsibleforclaiminginsuranceindemnificationsaccordingtotheproceduresandregulationsoftheinsurancecompanyandrefundtheexactindemnificationstoPartyB.partyBshallberesponsibleforalldamagesasidefromtheinsuranceindemnifications.5、乙方如發(fā)生違反交通法規(guī)的嚴(yán)重違法和交通事故，造成保險費率的上浮部分，由乙方承擔(dān)。具體上浮按保險公司標(biāo)準(zhǔn)執(zhí)行。Incaseofseriousaccidentorvehicledamages,PartyA’svehicleinsurancerategoupbyit,PartyBshallpaytheextraincreasedinsuranceexpensesaccordingtothecriterionofinsurancecompany.6、由乙方指定的駕駛員造成各類事故的車輛停駛和修理期間，甲方不免費提供替換車；乙方要承擔(dān)事故車停駛、修理期間的租金。DuringtheprocessingoftheaccidentcausedbythedriverdesignatedbyPartyB,PartyBshallberesponsibleforthevehiclerentstill.PartyAdonotprovidefreesubstitutionvehicle.7、乙方發(fā)生行車事故，無論有無責(zé)任，均按事故修理費的 10%補償甲方車輛的殘值損失。Inanycaseofvehicledamages,PartyBshallcompensatepartyAanamountatten(10)percenttotalexpensesfordamagecausedbyaccelerateddepreciation.8、乙方在租賃期間發(fā)生車輛丟失，須出示當(dāng)?shù)毓补芾聿块T出具的有效證明，由甲方向保險公司辦理索賠手續(xù)。乙方必須承擔(dān)車輛丟失后原車型三個月的租賃費和保險公司賠償后不足部分的車輛損失費。Iftheleasedvehicleisstolenduringtheleaseterm,PartyBshallprovideeffectiveevidenceissuedbyresidentsPoliceadministrationdepartment.AndPartyAshallberesponsibleforclaiminginsuranceindemnification.PartyBshallundertaketheresponsibilitiesofthree(3)monthsrentandalldamageexpensesasidefrominsuranceindemnifications.9、乙方必須嚴(yán)格遵守道路交通安全法和實施條例，確保行車的安全。如發(fā)生交通違法和交通事故或者被“電子警察”拍攝行為的，必須積極做好事后工作，自覺接受公安交警部門處理，并及時交納罰金，對于未繳納部分，甲方有權(quán)從押金中扣除。乙方歸還車輛7天以后，甲方退還乙方不計利息的押金余額。根據(jù)上海市機(jī)動車第三者責(zé)任保險費率浮動制度的規(guī)定，乙方必須承擔(dān)因為上述原因所至的所租車輛保險費費用上浮的責(zé)任。如果因為未接受公安交警部門處理而造成所作用車輛不能參加年度檢驗，致使車輛被強(qiáng)制停駛，乙方必須承擔(dān)相關(guān)責(zé)任和費用。PartyBshallstrictlyabidebythetrafficlawandregulationsduringtheleaseterm.Incaseofbreachoftrafficregulationandlaw(includingpoliceCCTV),PartyBshallberesponsibleforallrelatedpenaltyvoluntarily.PartyAhastherighttodeductthepenaltythatPartyBhasnotpaidfromthedeposit.PartyBwillberefundedthedepositwithoutinterestsafter7workingdaysoftheleasedcarreturned.AccordingtothefloatingregulationofShanghaithirdpersonliabilityriskinsurance,PartyBshallundertaketheresponsibilitiesfortheincreasedinsuranceexpensescausedbythereasonmentionedabove.Moreover,PartyBshallberesponsibilitiesforpenaltyandexpensesiftheleasedvehiclecannotpassannualcheckandevenarestoppedrunning.五、違約責(zé)任 LiabilitiesofBreachingtheContracts1、乙方如果不履行合同條款，甲方有權(quán)收回車輛，終止合同，并有權(quán)收取賠償金。PartyAhastherighttoterminatethecontractandtakebacktheleasedvehicleifPartyBfailstocarryouthisimportantobligationsunderthiscontractandmayclaimindemnificationfromPartyB.2、合同期滿后，乙方未辦理延期手續(xù)，也未按時歸還甲方車輛的，甲方有權(quán)提交司法機(jī)關(guān)，依法處理。給甲方造成經(jīng)濟(jì)損失的，按合同第一條第 4款予以賠償。Whenthedeadlineofthiscontractreached,PartyBshallreturntheleasedcarorexpendthecontractimmediately,orPartyAhastherighttoreporttojudicialofficeanddecideaccordingtolaw.PartyBshalltaketheresponsibilitiesforPartyA’seconomicdamagesaccordingto4termofArticle1ofthiscontract.3、在合同期內(nèi)因乙方原因提前終止合同，乙方須首先付清實際租賃期間的相關(guān)費用并賠償相關(guān)費用。租期壹月及壹月以上的，賠償甲方不低于合同總金額的 30%費用，租期壹周以上壹月以內(nèi)的支付合同未履行部分總租金 40%的費用補償給甲方。IncaseofterminatethecontractinadvancecausedbyPartyB,heshallpaythetotalrentandberesponsibleforrelatedexpenses.PartyBshallpayTen(30)percentpenaltyofthetotalrentiftheleasedtermcoversonemonthorabove.AndPartyBshallpaytoPartyATwenty(40)percentpenaltyoftheremainingrentiftheleasedtermcoversOneWeektoOneMonth.4、乙方應(yīng)嚴(yán)格按照本合同履行其義務(wù)，由于乙方未能完善履行其義務(wù)而造成的損失，均由乙方自行承擔(dān)，造成甲方任何損失，乙方應(yīng)付賠償責(zé)任。PartyBshallstrictlycarryouthisresponsibilitiesofthiscontractandbeartotalresponsibilitiesvoluntaryfordamagesandexpensescausedbyincompletelyfulfillingresponsibilities.AndPartyAisentitledtoclaimindemnificationsfromanydamagescausedbyPartyB.六、其他 Others1、本車使用93型號燃料，因未使用指定燃料造成的車輛損失等后果由乙方承擔(dān)。車輛燃料費用由乙方自理。還車時，若車內(nèi)存油低于出廠時存油，乙方要按市場價向甲方繳納所差油費。Theleasedvehiclesuits93(model)gasoline.PartyBshallbearalldamagescausebymisusinggasoline.PartyBitselfshalltakethegasolinecostduringleasedtermandpaythebalancegasolinefeecomparewithoutcometimeaccordingtothetemporalgasolineprice.2、因車輛行駛中發(fā)生故障給乙方造成保險責(zé)任范圍以外的經(jīng)濟(jì)損失，甲方不予負(fù)責(zé)。PartyAdoesnottakeresponsibilitiesforPartyB’sdamagesoutofinsuranceforcecausedbymachineconkout.3、履行合同中發(fā)生異議的，由雙方協(xié)商解決，協(xié)商不成而提出訴訟，由甲方所在地人民法院受理。Anydisputesarisingfromorinconnectionwiththiscontractshallbesettledthroughamicableconsultation.Incasenosettlementisreachedthroughconsultations,thetwopartiesagreetoreferthedisputestothePeople’scourtforsettlementinPartyA’sarea.4、合同期間，乙方司機(jī)發(fā)生電子警察違章抄報者，乙方應(yīng)積極配合處理違章，否則甲方有權(quán)按乙方租賃時登記司機(jī)的駕駛證上報交通管理部門，由交通管理部門負(fù)責(zé)催辦，直至吊銷駕駛證，其后果由乙方自負(fù)。IncaseofrecordedbyPoliceCCTV,thedriversdesignatedbyPartyBshallpositivelytakethetreatmentandpaythepenaltyintime.Otherwise,PartyAisentitledtoreportthedrivers
