AirTransportEssentialsBasicConceptofAirTransport民航旅客國(guó)際運(yùn)輸?shù)亩x民航旅客國(guó)際運(yùn)輸(INTERNATIONALAIRPASSERGER)是民航旅客運(yùn)輸中的重要組成部分,也是民航旅客運(yùn)輸中最具潛力、發(fā)展最快的部分,是世界各國(guó)主要航空公司的重要業(yè)務(wù)之一。關(guān)于民航國(guó)際運(yùn)輸?shù)亩x,《華沙公約》所給出的定義是:就本公約而言,國(guó)際運(yùn)輸是指:根據(jù)有關(guān)各方所訂契約,不論在運(yùn)輸中有無(wú)間斷或轉(zhuǎn)運(yùn),其出發(fā)地和目的地是處在兩個(gè)締約國(guó)領(lǐng)土內(nèi),或處在一個(gè)締約國(guó)的領(lǐng)土內(nèi)而在另一國(guó)的主權(quán)、宗主權(quán)、委任統(tǒng)治權(quán)利或權(quán)利管轄下的領(lǐng)土內(nèi)有一個(gè)協(xié)議的經(jīng)停地點(diǎn)的運(yùn)輸??梢?jiàn),民航旅客國(guó)際運(yùn)輸?shù)亩x是:如果旅客與承運(yùn)人簽署的契約中要求的運(yùn)輸始發(fā)地和目的地不在同一國(guó)家內(nèi),或者在同一國(guó)家內(nèi),但在另一國(guó)家有至少一個(gè)約定的經(jīng)過(guò)停留地,這樣的運(yùn)輸被稱(chēng)為“民航旅客國(guó)際運(yùn)輸”,簡(jiǎn)稱(chēng)“民航國(guó)際客運(yùn)”或“國(guó)際客運(yùn)”。

國(guó)際民航組織(ICAO)的全稱(chēng)是INTERNATIONALCIVILAVIATIONORGANIZATION,是協(xié)調(diào)各國(guó)有關(guān)民航經(jīng)濟(jì)和法律義務(wù),并制定各種民航技術(shù)標(biāo)準(zhǔn)和航行規(guī)則的政府間的國(guó)際組織。

大會(huì)是國(guó)際民航組織的最高權(quán)利機(jī)構(gòu),理事會(huì)是向大會(huì)負(fù)責(zé)的常設(shè)機(jī)構(gòu),在大會(huì)休會(huì)期間,理事會(huì)代表所有締約國(guó)處理日常事務(wù)。理事會(huì)由33個(gè)理事國(guó)組成,由每屆大會(huì)選舉產(chǎn)生。大會(huì)由理事會(huì)在適當(dāng)?shù)臅r(shí)間和地點(diǎn),每三年至少召開(kāi)一次。在理事會(huì)下國(guó)際民航組織還建立了航空運(yùn)輸委員會(huì)、航行委員會(huì)、財(cái)務(wù)委員會(huì)、防止非法干擾委員會(huì)、聯(lián)營(yíng)導(dǎo)航委員會(huì)和法律委員會(huì)。秘書(shū)處是國(guó)際民航組織的常設(shè)行政機(jī)構(gòu),由秘書(shū)長(zhǎng)負(fù)責(zé)保證國(guó)際民航組織各項(xiàng)工作的順利進(jìn)行。秘書(shū)長(zhǎng)由理事會(huì)任命。在國(guó)際民航組織內(nèi)的日常辦事機(jī)構(gòu)還有航空技術(shù)局、航空運(yùn)輸局、法律局、技術(shù)援助局、行政服務(wù)局和對(duì)外關(guān)系辦公

秘書(shū)處下有一個(gè)地區(qū)事務(wù)處和7個(gè)地區(qū)辦事處,這7個(gè)地區(qū)辦事處分別是:1、西非和中非地區(qū)辦事處,位于塞內(nèi)加爾首都達(dá)喀爾。2、亞太地區(qū)辦事處,位于泰國(guó)曼谷。3、東非和南非地區(qū)辦事處,位于肯尼亞內(nèi)羅畢。4、歐洲地區(qū)辦事處,位于法國(guó)巴黎。5、中東地區(qū)辦事處,位于埃及開(kāi)羅。6.北美和加勒比地區(qū)辦事處,位于墨西哥的墨西哥城。7.南美地區(qū)辦事處,位于秘魯利馬。

1971年10月25日,聯(lián)合國(guó)第26屆大會(huì)通過(guò)2758號(hào)決議,恢復(fù)我國(guó)在聯(lián)合國(guó)組織中的合法席位。同年11月19日國(guó)際民航組織第74屆理事會(huì)第十六次會(huì)議做出相應(yīng)決定,恢復(fù)中華人民共和國(guó)的合法權(quán)利。我國(guó)于1974年承認(rèn)芝加哥公約并自該日起參加國(guó)際民航組織的有關(guān)活動(dòng)。從1974年起,我國(guó)連續(xù)當(dāng)選為理事國(guó),并在蒙特利爾設(shè)有常駐國(guó)際民航組織的代表。
相關(guān)公約:芝加哥公約1、締約國(guó)承認(rèn)每一個(gè)國(guó)家對(duì)其領(lǐng)空具有完全的排他的主權(quán);2、根據(jù)國(guó)際航空運(yùn)輸?shù)陌l(fā)展和實(shí)踐,公約對(duì)定期航班和不定期航班飛行的權(quán)利做出了有關(guān)規(guī)定;3、對(duì)從事國(guó)際飛行的航空器的國(guó)籍和航空器應(yīng)具備的條件做出了規(guī)定;4、締約各國(guó)同意采取一切可行的措施,通過(guò)發(fā)布特別規(guī)章或其他方法,以便利和加速航空器在締約各國(guó)之間的航行。相關(guān)公約:芝加哥公約5、制定了國(guó)際民航技術(shù)標(biāo)準(zhǔn)和建議的措施。國(guó)際民航組織隨后將這些方面的標(biāo)準(zhǔn)和建議的措施作為公約的附件公布實(shí)行。迄今為止,該附件數(shù)量已經(jīng)達(dá)到18個(gè)。6、關(guān)于國(guó)際民航運(yùn)輸遞交統(tǒng)計(jì)材料和聯(lián)營(yíng)問(wèn)題的規(guī)定。
7、關(guān)于組成國(guó)際民航組織的規(guī)定相關(guān)公約:華沙公約《華沙條約》《華沙條約》簽定于1929年10月12日,全稱(chēng)是《統(tǒng)一國(guó)際航空運(yùn)輸某些規(guī)則的條約》,是民航國(guó)際旅客運(yùn)輸中第一部重要的航空法律?!度A沙條約》于1933年2月13日生效。我國(guó)于1958年7月20日送交了加入書(shū),使該公約于同年10月18日在我國(guó)生效。
相關(guān)公約:華沙公約公約共分5章41條,對(duì)國(guó)際航空運(yùn)輸?shù)亩x、運(yùn)輸憑證和承運(yùn)人責(zé)任作出了明確規(guī)定。公約特別規(guī)定,在運(yùn)輸過(guò)程中由于承運(yùn)人的過(guò)失使旅客、托運(yùn)人或收貨人遭受損失,承運(yùn)人應(yīng)該承擔(dān)賠償責(zé)任。公約同時(shí)規(guī)定,承運(yùn)人對(duì)每名旅客的最大賠償責(zé)任是12.5萬(wàn)金法郎,行李和貨物每公斤250金法郎,旅客手提行李每人不超過(guò)5000金法郎。這里的金法郎是指含有900/1000成色的65.5克黃金的金法郎。這些金額可以折合成任何國(guó)家的貨幣,并取整數(shù)。
相關(guān)公約:《服務(wù)貿(mào)易總協(xié)定》與航空運(yùn)輸附件世界貿(mào)易組織(WTO)、《服務(wù)貿(mào)易總協(xié)定》與航空運(yùn)輸附件世界貿(mào)易組織的前身是締約于1947年、正式生效于1948年的關(guān)稅與貿(mào)易總協(xié)定,它是一項(xiàng)有關(guān)關(guān)稅和貿(mào)易的多邊國(guó)際協(xié)定,同時(shí)也是一個(gè)調(diào)整締約國(guó)之間經(jīng)濟(jì)貿(mào)易關(guān)系方面的國(guó)際組織。根據(jù)客觀(guān)形勢(shì)的要求,關(guān)稅與貿(mào)易總協(xié)定于*年更改為世界貿(mào)易組織,總部位于瑞士日內(nèi)瓦。
《服務(wù)貿(mào)易總協(xié)定》與航空運(yùn)輸附件1986年9月在烏拉圭發(fā)動(dòng)的烏拉圭回合,最后于1994年4月15日發(fā)表了“馬拉喀什部長(zhǎng)宣言”,并最終形成了世界貿(mào)易組織國(guó)際法體系的《服務(wù)貿(mào)易總協(xié)定》?!斗?wù)貿(mào)易總協(xié)定》包括29條和8個(gè)附件,航空運(yùn)輸附件是其中之一。《服務(wù)貿(mào)易總協(xié)定》將服務(wù)貿(mào)易定義為“國(guó)際間服務(wù)的提供”,包括某項(xiàng)服務(wù)的生產(chǎn)、分配、營(yíng)銷(xiāo)、銷(xiāo)售等一系列活動(dòng)。
《服務(wù)貿(mào)易總協(xié)定》與航空運(yùn)輸附件《服務(wù)貿(mào)易總協(xié)定》認(rèn)為,服務(wù)貿(mào)易的形式包括:1、跨境服務(wù):表示從一國(guó)境內(nèi)向其他國(guó)家境內(nèi)提供的服務(wù),它沒(méi)有人員、物資的流動(dòng),而是通過(guò)電信、郵電、互聯(lián)網(wǎng)等實(shí)現(xiàn)的。2、境外消費(fèi):表示在一國(guó)境內(nèi)為其他國(guó)家的消費(fèi)者提供的服務(wù)。3、商業(yè)存在:某一國(guó)的服務(wù)者通過(guò)到其他國(guó)家境內(nèi)成立公司、分支機(jī)構(gòu)等實(shí)體來(lái)為其他國(guó)家的用戶(hù)提供服務(wù),它是服務(wù)貿(mào)易中最普遍的形式。4、自然人移動(dòng):某一國(guó)的自然人通過(guò)在其他國(guó)家的存在來(lái)為有關(guān)用戶(hù)提供服務(wù)。
《服務(wù)貿(mào)易總協(xié)定》與航空運(yùn)輸附件在民航運(yùn)輸服務(wù)領(lǐng)域里,早在1990年國(guó)際民航組織就與當(dāng)時(shí)的關(guān)稅與貿(mào)易總協(xié)定達(dá)成共識(shí):在民航運(yùn)輸業(yè)的“硬約束”方面,即航空權(quán)、航路、航空器適航、飛行安全、人員執(zhí)照等方面要受?chē)?guó)際民航組織簽署的協(xié)議和頒發(fā)的規(guī)則的約束;在民航運(yùn)輸業(yè)的“軟約束”方面,即民用航空器貿(mào)易、民航客貨運(yùn)輸銷(xiāo)售、計(jì)算機(jī)定座、航空器及附件的維修方面,需要受到當(dāng)時(shí)的關(guān)稅與貿(mào)易總協(xié)定的原則和規(guī)則的約束。
